Other relevant legislation
Under the Education Act 1989 the National Administration Guideline 5(c) (NAG5) states that the board is required to comply in full with any legislation currently in force or that may be developed to ensure the safety of students and employees. NAG5(c) reinforces that a boards must comply with Health and Safety legislation. While NAG 5 is not about workplace health and safety it overlaps with the HSWA duties and schools/kura are required to meet the requirements of both.
Boards are also required to comply with section 77A of the State Sector Act 1988 which requires boards to be “good employers”, including ensuring “good and safe working conditions”.
Employee collective agreements also contain provisions for health and safety.
Under section 7A of the Smoke-free Environments Act 1990, smoking is prohibited at schools/kura.
